A judge has ordered Microsoft to allow litigating states access to its source code. District Judge Colleen Kollar-Kotelly’s instruction applies to the Windows operating system, including XP and XP Embedded.

The nine states have argued that they must be allowed to access the Windows source code to verify Microsoft’s claim that the operating system and other elements such as Internet Explorer cannot be separated.

Meanwhile, Microsoft has announced it is to open some of its source code under its Shared Source Initiative. Access will be granted to 150 systems integrators initially. These will be limited to those who are Gold Support Services certified partners and system integrators with more than 1500 seats of Windows with a level A or B Microsoft premier support agreement.
