Reports are circulating this morning that telco UPC has defeated a case brought against it by recording industry body IRMA seeking to introduce a ‘three-strikes’ rule regarding copyrighted material. Under the terms of the proposal, already agreed with eircom, users would be subjected to analysis by a forensic firm to identify customers on the UPC network, which in turn would be serviced with a copy of the IP addresses of users engaged in illegal file sharing. The service provider would then be obliged to issue two warnings to infringing users before cutting off their Web broadband service on a third documented offense.
The controversial proposals have been countered with the argument that a service providers supply a ‘mere conduit’ to the Web, and are therefore not responsible for what user activity.
