
European organisations accuse X of violating EU privacy legislation
Nine civil society organizations have filed a formal complaint with the European Commission against Elon Musk’s social media platform X, citing breaches of the Digital Services Act (DSA).
The complaint, submitted by groups including European Digital Rights (EDRi), AI Forensics, and the Centre for Democracy and Technology Europe (CDT), concerns the alleged use of sensitive personal data for targeted advertising.
Evidence collected by AI Forensics from X’s Ad Repository shows that many organisations – including major brands, government agencies, and financial institutions – have engaged in targeted advertising based on sensitive categories of personal data. These categories include political opinions, sexual orientation, religious beliefs, and health status.
The Digital Services Act, which came into force at the end of 2023 for large online platforms such as X, explicitly prohibits the use of these special categories of data for targeted advertising based on profiling. As an example cited in the complaint, AI Forensics found evidence that X allowed the energy company Total Energies to exclude users who had interacted with keywords related to green politicians from seeing their ads.
