Bebo judgments affect users on the double

In two decisions this week the courts have censured a 27 year-old man for posting inappropriate content on a teenaged girl’s Bebo page, while a former employee of clothing chain A-wear received over €4,000 in damages for unfair dismissal following a comment posted on the site.

Father of one Paul Anthony Matthews of Doylesfort Road, Dundalk, agreed to pay a a teenaged girl €3,000 after posting obscene messages on her profile page.

Commenting on the case, Judge Conal Gibbons noted this was the first case of its kind and was outraged that messages that were “offensive and damaging” could be made public.

The girl, who cannot be named after the imposition of a court order, was 16 at the time of the incidents.

In a second case, Emma Kiernan of Ferns Road, Crumlin, was found to have been unfairly let go from her job as a shop assistant after writing on her Bebo page about being able to contact a member of management to explain her absence from work. After an exchange with management Kiernan wrote that she hated the her co-worker in a posting replete with expletives. Kiernan was let go from her position once the content of her posting became known.

While the court found that company policy had been followed the level of censure was deemed to be unfair and Kiernan was awarded €4,000 for wrongful dismissal and a further €750 for two-weeks notice.
