Apple's trail of destruction continues



TechLife | 13 Oct 2011 :  Following on the heels of decisions in the Netherlands and Germany, the Federal Court of Australia has issued a temporary ionjunction banning the sale of Samsung's Galaxy Tab 10.1.

Apple is suing Samsung on the basis that the touch screen used in the Tab 10.1 had breached copyright rules.

The decision was secured against the South Korean company after Apple successfully argued that sales of its iPad 2 tablet would be adversely affected while it prepared its case. In her ruling in favour of the plaintiff, Justice Annabelle Bennett said: "Despite the force of Samsung's submissions I have found that Apple has established a prima facie case of infringement of claims of both its patents."

The case will now proceed to trial, where it is expected the decision will be upheld. Similar actions are underway in the US and South Korea.
